Recently, a friend asked for my help in corresponding with her former landlord seeing charges taken from her rental security deposit she felt were unwarranted.

Custodial – this type of coverage requires the landlord to cover the complete quantity of the deposit into a documented scheme. The cash is held in the scheme before the tenant leaves the property. Providing there are no disputes that the deposit is paid back to the renter. Where there is a dispute the scheme uses an adjudicator to arbitrate between landlord and tenant. The adjudicator’s decision is normally final. Insurance – with an insurance policy type scheme the landlord keeps the entire deposit. The landlord pays a fee for insurance to protect the deposit. The insurance must be obtained with a government approved strategy. When the tenant leaves the house the landlord repays down the deposit to the tenant. Insurance type schemes also have an adjudicator service if there is a dispute. When a dispute does arise that the adjudicator will require the landlord to cover the full deposit into the scheme while the dispute is researched.

A landlord has 28 days to register a deposit with a custodial or insurance type scheme. Information concerning the registration of the deposit has to be provided to the renter. Under the Housing Act there is a prescribed format for information to be supplied. The landlord can be taken to court by the tenant where the information has not been supplied in the correct format. Tenants have the right to go back six years before taking action against the landlord.

Each time a property is renewed that the insurance on the deposit must also be renewed for example if the landlord has a six monthly Assured Shorthold Tenancy and writes a new tenancy agreement in the end of the six months afterward the deposit must also be renewed. To save on costs many landlords issue a tenancy for a fixed term period with a clause stating the tenancy becomes a monthly contractual lien in the conclusion of their fixed term. By having one tenancy for the duration of time a renter is in the property that the landlord need only pay 1 fee to protect the deposit.
